Membership terms and conditions

PLEASE READ THE FOLLOWING INFORMATION CAREFULLY BEFORE AGREEING TO AND ACCEPTING THESE TERMS AND CONDITIONS.

Since you do not sign these terms and conditions, your acceptance and use of your swipecard constitutes acceptance of and agreement to these terms and conditions.

The gym premises are under 24 ‐hour camera surveillance.

Whether you are working out, entering/leaving the building/restrooms, all activities are being recorded.

This video system is used for security purposes.

The surveillance system does not protect you from harm in or near the building premises.

You must use caution when entering or leaving the building. A courtesy telephone to “000” is available if you feel threatened or witness suspicious activity.

Do not allow access to individuals who knock on the door; doing so may put you at risk or harm and could result in you

losing your membership privileges.

MEMBER ASSUMPTION OF RISK AND RELEASE:

I understand the risk of injury from gym activities and using any club equipment is significant, including the potential for permanent paralysis and death.

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, known and unknown.

I acknowledge that this is an UNSUPERVISED gym facility and I assume all risks associated with using the exercise equipment.

I acknowledge exercising alone without the aid and presence  of gym staff on the premises.

I hereby RELEASE, INDEMNIFY,  AND HOLD HARMLESS PARFCITNESS PTY LTD, the gym, their respective owners, officers, affiliates, agent

and employees, other participants, sponsoring agencies, sponsors, advertisers and owners and lessors of the premises,

including the Eastern

Suburbs Rugby Union Club (Releasees) WITH RESPECT TO ANY AND ALL INJURY,

DISABILITY, DEATH, LOSS OR DAMAGE to persons or property, WHETHER

ARISING FROM THE NEGLIGENCE OF THE RELEASEES or otherwise which may arise out of

or in connection with my use of the equipment or the facilities of the gym

or any incident that occurs while using the facilities or engaging in gym activities

on or off the premises or otherwise related to my gym membership.

I expressly agree that this release is intended to be as broad and inclusive as permitted

by the laws of this state and if a part of this release is held

invalid, the balance will remain in full force and effect. This release shall apply

to my heirs and assigns and in the case of a family membership, to any minor

 included in my membership and on whose behalf I hereby sign as a parent/guardian.

I understand that the gym is relying on this release in agreeing to enter into this Agreement.

MEMBER NOTICES

MEMBERS may not bring in guests at any time without the prior written

consent of the gym. Furthermore if this prohibition is violated,  at the sole discretion

of the gym management, the MEMBER may becharged a guest fee and

/or have his/ her membership suspended or cancelled, the balance of the contract

declared due and payable in full immediately and be assessed apenalty of up to $250.

MEMBERS may not allow anyone else to use their access cards and must alert the gym

immediately if it is lost or stolen. Violating this policy carries the

same penalties as violating the guest policy.

MEMBERS who does not have their access card will not be allowed into the gym

during non-staffed hours nor should they expect for anyone else to let them into the gym.

Personal training services provided in the gym may be provided either by employees or

by independent contractors operating their own business.

All MEMBERS have access to free orientation of the gym and the proper use of its

equipment; it is the MEMBER’S responsibility to request this orientation.

MEMBERS are hereby required to acquaint themselves with and use the safety

features of the equipment.

If a MEMBER is unsure how to use a machine, he/she should not use the

equipment or seek instructions from a personal trainer.

Horseplay, vulgar language, abuse of the equipment, working out whilst

intoxicated or other inappropriate behaviour will not be tolerated and may

result in suspension

or cancellation of the offending MEMBER’S membership, and the balance

of the contract being declared due and payable in full immediately.

Photography and videography are not permitted anywhere in the gym.

There is a $20 replacement fee for a lost card.

MEMBER RIGHT TO CANCEL

If you wish to cancel your membership contract, you may cancel by emailing office@parcfitness.com.au.

No cancellation fees will apply.
